The following is an analysis by Sam McTyre of some critical changes proposed by Project 2025, “Mandate for Leadership; The Conservative Promise,” concerning the Department of Homeland Security for implementation by Donald Trump if he is elected in 2024.
Project 2025 recommends dismantling the Department of Homeland Security and reorganizing its components to achieve more efficient and focused mission outcomes. The recommendations were authored by Ken Cuccinelli, a longtime supporter of Former President Donald J. Trump who served in the Trump Administration as a Senior Official Performing the Duties of the United States Deputy Secretary of Homeland Security.
Critical elements of immigration law, including border policy, asylum reform, and deportation policies, would be changed to conform to Donald Trump’s restrictive immigration thinking.
Border Policy
The proposed border security policy changes include legislative proposals, regulations, executive orders, and sub-regulatory matters such as
Creating an authority for expelling illegal aliens immediately,
mandating funding for border wall system infrastructure,
Prioritizing national security in specific programs,
Implementing expedited pathways for border crossers,
Reforming employment authorization,
Authorizing state and local law enforcement to participate in immigration actions
aggressive building of the border wall system,
Involving the Department of Defense in border defense,
leading international engagement on security and migration issues and imposing sanctions on countries that do not promptly accept deportees.
Asylum Reform
The proposed asylum reform includes measures such as
Creating an expedited removal process,
Limiting asylum eligibility criteria,
Enhancing vetting procedures,
Increasing resources for processing,
Establishing stricter standards for credible fear interviews,
Deterring fraudulent claims,
Potentially relocating processing offices,
Raising the standard for credible fear of persecution,
Codifying asylum bars and transit rules,
Potentially eliminating the protected ground of particular social group,
Restricting prosecutorial discretion,
Mandating E-Verify,
Ending the abuse of parole,
Halting funds to NGOs for processing illegal aliens, and
Enhancing the integrity of the asylum system.
Deportation Policy
The deportation policy outlined by Project 2025 includes several key points, such as:
Directing ICE to apply the Immigration and Nationality Act as written by Congress to prevent the release of illegal aliens.
Instructing ICE to prioritize taking custody of criminal aliens with records for felonies, crimes of violence, DUIs, previous removals, and other crimes considered threats to national security or public safety.
Recommending the elimination of T and U visas in favor of using the S visa for victims actively cooperating with law enforcement.
Providing clear guidance on detention and bond for aliens to prevent their release and potential criminal activities.
Focusing HSI Special Agents on enforcing crimes related to alien smuggling, trafficking, and cross-border crime.
Assigning ERO the responsibility for enforcing civil immigration regulations, including arrest, detention, and removal of immigration violators.
Rescinding memoranda identifying “sensitive zones” where ICE personnel are prohibited from operating, allowing officers to exercise judgment appropriately.
Expanding expedited removal,
Increasing resources for detention and removal,
Enhancing coordination between federal agencies,
Streamlining removal processes,
Implementing stricter consequences for illegal entry,
Deterring unlawful immigration through enforcement actions,
Potentially relocating detention facilities,
Enforcing existing immigration laws,
Enhancing border security and
Ensuring compliance with court rulings like Matter of A-B-.
